Discrimination and A “Similar, Newly Created Position”

The Justice Department recently entered into a settlement agreement with the University of Baltimore to resolve allegations that the University discriminated against a female employee based upon her pregnancy, violating Title VII of the Civil Rights Act of 1964.  The case could apply to any organization, regardless of industry.  According to DOJ, shortly after an employee informed the University that she was pregnant, her position was eliminated and her employment was terminated.  Shortly thereafter, the University advertised for a “similar, newly created position” for which she was not hired.  There’s more to the story though, including a senior University official making comments indicating that the employee’s pregnancy was a factor in terminating her employment.
